On August 22, 2014 I will be teaching defense attorneys from all over Maine how to defend OUI cases.

This will be thirty plus for me and nearly as many for John. While my teaching experience has been limited to Maine, John’s has included teaching OUI defense at national seminars. Our students have included defense attorneys (predominantly), prosecutors, police officers, judges, legislators and administrative hearing examiners.

John’s topic is called: Case Law Round Up.

John has reviewed cases from all fifty state Supreme Courts, Federal Circuit Courts and the United States Supreme Court that relate, in any way, to the defense of OUI cases (John performs this yeoman task annually to prepare for his presentation). He will teach, much like a law school professor, his students the current state of the law as it pertains to search and seizure (Fourth Amendment), Confrontation Clause (Sixth Amendment), use of prior convictions to enhance new alleged crimes, immigration implications and the plethora of court decisions that affect the everyday lives of those accused of crimes.

I will be teaching our students about topics ranging from how to legitimately challenge breath tests with Maine’s “latest and greatest” machine, the Intoxilyzer 8000, to how to use beautiful Maine Coon Cat kitties to successfully defend folks accused by the government (bet that makes you want to sign up right now !).

Many people, lawyers and folks in other businesses, ask me: Why are you guys teaching the stuff that you’ve worked so hard to learn to your competitors?

Well, I must concede that we lose business, we lose money doing this. However, I tell them, we are not seeking a monopoly on how to effectively represent those accused of OUI. We are simply doing our sworn duty to ensure that, as the Constitution requires, ALL persons accused of crimes are afforded a zealous and effective defense. It matters not whom you hire; but whomever you hire to represent you must be equipped with the knowledge and skill to honor that Constitutional mandate. That is why we continue to learn and that is why we continue to teach.

If you have been charged with OUI, you deserve to have your Constitutional right to an effective and zealous defense. Protect your rights and call us for a free consultation at Nichols & Tucker. Portland (207-879-4000).
