Casco Bay Bridge OUI

Casco Bay Bridge OUI

State v. B.A.

Blood / Alcohol Content (BAC):

.10%

Defense:

Margin of error, validity of field sobriety tests

Defense Attorney:

Matthew B. Nichols

Offense:

Operating Under the Influence (OUI, DUI, DWI)

Maximum Sentence:

364 days in jail, 90 days license suspension and $500 fine

Synopsis:

Client was stopped for erratic operation and performed poorly on field sobriety tests. The tests were conducted near the apex of the Casco Bay Bridge. Client was arrested and blew 0.10% BAC on the Intoxilyzer.

The field sobriety tests were rejected, in part, because of the manner and location in which they were performed. And the test result was rejected due to the applicable margins of error.

Verdict:

Not Guilty
